This Privacy Policy (Policy) governs the collection, use, storage, disclosure, and rights of individuals with respect to their Personal Information by Walburg Art Enterprise LLC, a California limited liability company, (Walburg Art Enterprise, Company, we, us, or our), with principal offices at Sacramento, California. This Policy is hereby incorporated by reference into the Terms of Service. By accessing or using our website at https://www.gswalburg.com (the Site or Website) and by purchasing our products or engaging with our services, you acknowledge your acceptance of this Privacy Policy. If you do not agree with the terms of this Policy, you may not use the Site or provide any Personal Information to us.

1. Definitions.

A. Personal Information. Personal Information means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household as defined under the California Consumer Privacy Act of 2018 (as amended by the California Privacy Rights Act of 2020) (CCPA/CPRA) and other applicable privacy laws, including, without limitation, identifiers such as real name, alias, postal address, unique personal identifier, online identifier, email address, account name, payment or financial information, records of products purchased, or other similar identifiers.

B. Sensitive Personal Information. Sensitive Personal Information means personal information that reveals social security number, driver’s license number, state identification card, passport number, account log-in together with access credentials, precise geolocation, racial or ethnic origin, religious or philosophical beliefs, or union membership, contents of mail, email, and text messages not directed to the business, or genetic data, and as otherwise defined under applicable law.

C. Products. “Products” includes the Goods described in the Sales and Purchase Agreement for Sculptures and 2D Artwork, including original or limited-edition sculptures and 2D artworks, paintings, prints, drawings, and mixed media objects.

D. User/Consumer/You. Any natural person who uses the Site, purchases Products, or otherwise interacts with the Company in a capacity as a consumer.

2. Scope of Policy.

A. Jurisdiction and Audience. This Policy applies to all Personal Information collected from individuals residing in California and the United States. The Website is intended for use solely by individuals at least eighteen (18) years of age and legally capable of entering into binding contracts. We do not knowingly collect Personal Information relating to minors under the age of 13.

B. Incorporation by Reference. This Policy is expressly incorporated into and forms part of the Terms of Service and the Sales and Purchase Agreement between you and the Company, if any.

3. Categories of Personal Information Collected.

We may collect the following categories of Personal Information, which may vary depending on your interaction with the Site:

A. Identifiers. Real name, alias, postal address, unique personal identifier, email address (including for account registration and newsletter subscriptions), online identifier, IP address, account username, and password or credentials relating to any Company account.

A. Cookies and Similar Technologies.  The Site is hosted on Squarespace and uses cookies, pixels, and similar tracking technologies to ensure proper functionality, enhance performance, and improve user experience. These technologies may include:

·       Strictly Necessary Cookies: Required for core website functionality, including page navigation, security, checkout processes, and maintaining user session preferences. These cookies cannot be disabled as they are essential to operation of the Site.

A. Safeguards. The Site utilizes a secure hosting infrastructure provided by Squarespace, which includes industry-standard technical and organizational security measures designed to protect Personal Information against unauthorized access, disclosure, alteration, or destruction. D. Breach Notification.  In the event of a data breach resulting in unauthorized access to Personal Information, we will comply with all applicable legal obligations, including notification and remediation requirements under California law.

12. Children’s Privacy.

A. The Site is not directed to children under the age of 13, and we do not knowingly collect or solicit Personal Information from minors. If we discover that we have inadvertently collected such information, we will promptly delete it in compliance with applicable law.

B. If you are a parent or guardian and believe that your child under age 13 has provided us with Personal Information without your consent, you may contact us to request deletion.

A. The Site may contain links to third-party websites or services not operated or controlled by Walburg Art Enterprise LLC. We are not responsible for the privacy practices, policies, or content of such third-party sites. When you follow a link to a third-party site, you are subject to that sites privacy practices and policies.

14. Changes to This Privacy Policy.

A. Walburg Art Enterprise LLC reserves the right to amend or update this Policy at any time, in its sole discretion. Material modifications will be indicated by a change in the Effective Date at the top of this page. Your continued use of the Site after such changes constitutes your acceptance of the updated Policy.

B. We recommend that you review this Policy periodically to remain informed regarding our privacy practices.

15. California Shine the Light Law and Do Not Track Disclosures.

A. Shine the Light. Under California Civil Code Section 1798.83, California residents may request information regarding our disclosures, if any, of Personal Information to third parties for their direct marketing purposes during the prior calendar year. To make such a request, please submit a written request using the contact information provided herein. We do not disclose Personal Information to third parties for their direct marketing purposes without your express consent.

B. Do Not Track Signals. Our Site does not respond to browser Do Not Track signals at this time.

18. Incorporation into Related Agreements.

This Privacy Policy is an integral part of, and is incorporated by reference into, the Terms of Service and the Sales and Purchase Agreement for Sculptures and 2D Artwork. In the event of any inconsistency between this Policy and other agreements with us, the Policy will control with respect to the collection, handling, and disclosure of Personal Information.

19. Governing Law.

This Policy shall be governed by and construed in accordance with the laws of the State of California, without regard to its principles of conflicts of law. Any dispute arising out of or relating to this Policy shall be resolved in accordance with the dispute resolution provisions set forth in the Website Terms of Service, which are incorporated herein by reference.
